As stated in Article 35k of the State Ordinance on the Supervision of the Credit System, Article 16j of the State Ordinance on the Supervision of the Insurance Business and Article 16a of the State Ordinance on the Supervision of Trust Service Providers, the CBA may issue a public warning in the event of a violation of a prohibition of these State Ordinances in order to safeguard the interests these State Ordinances seek to protect. However, under Article 6:162 of the Aruban Civil Code, the CBA has a general duty of care to warn consumers against fraudulent and other illegal practices. Public warnings are issued via press release and are also published on the CBA’s website.
